Claiming that the process of settlement and compilation of record of appeal for the hearing of the appeal filed by the Deputy Governor would violate their rights, the claimants in the case had sued four registrars of the High Court, the Deputy Governor, the House of Assembly, the Speaker of the House, and the Chief Judge of Ondo State.

The lawsuit over the compilation of the appeals record, which was brought by the Ondo State government and Governor Oluwarotimi Akeredolu, was dismissed by an Akure High Court on Monday.

Claiming that the process of settlement and compilation of record of appeal for the hearing of the appeal filed by the Deputy Governor would violate their rights, the claimants in the case had sued four registrars of the High Court, the Deputy Governor, the House of Assembly, the Speaker of the House, and the Chief Judge of Ondo State.

 

The claimants, via their attorneys, filed an application to drop the action on Monday when Justice D. I. Kolawole heard the case. They claimed that circumstances had taken precedence over the lawsuit.

In response, the Deputy Governor’s attorney contested the oral request to withdraw the lawsuit, arguing that problems had been raised by submitting a counterclaim as well as a defense to the lawsuit.

The judge ruled that the lawsuit was struck out since the claimants were allowed to withdraw under the court’s procedures.

The Deputy Governor’s attorney then pleaded with the court to instruct the parties to keep things as they are in order to keep the lawsuit’s subject matter alive.

The attorney for the House of Assembly objected to the application.

After deciding on the application, the court ordered all parties to keep the peace and postponed the matter until November 22, 2023, when the applications will be heard.
