The All Progressives Congress (APC) must hold a new primary election in the Akoko South East/Akoko South-West Federal Constituency of Ondo State, according to an order from the Federal High Court in Akure.
In order to hold the election within the next seven days, the party must notify the Independent National Electoral Commission.
The decision was made as a result of a consent judgment that was rendered on Thursday in the Victor Ategbole lawsuit.
He is a candidate who previously asked the court to declare the primary, which Adegboyega Adefarati won, invalid on the grounds that it was not held at the specified location.
He claimed that it was held outside of the federal constituency in Akure, the state capital.
The INEC was mandated to hold a new poll within seven days by the court, which was presided over by Demi Ajayi.
Within seven days of this Thursday, the APC is anticipated to write to INEC to announce that it is prepared to hold a new primary election at St. Patrick Secondary School in Iwaro-Oka for the Akoko South-east/Akoko South-west Federal Constituency.
According to reports, parties concurred on the stance in the overall interest of the APC.
Respondents in the lawsuit included Mr. Adefarati, the APC, its national chairman, its state chairman, Ade Adetimehin, and the Independent National Electoral Commission.
The out-of-court settlement that all parties to the dispute agreed upon served as the foundation for the court’s ruling.
It is hereby agreed between the plaintiff on the one part and the first, second, third, and fourth defendants on the other part that the present suit as constituted be discontinued in the interest of the All Progressives Congress, according to a copy of the written terms of settlement from the court signed by the plaintiffs, defendants, and their attorneys.
It is further agreed that the second defendant, the All Progressives Congress, shall write officially to the fifth defendant stating its readiness to conduct a new APC primary for the Akoko South-East and Akoko South-West federal constituency at the approved venue of the primaries, which is St. Patrick’s Secondary School, Iwaro-Oka, within seven days of the date this terms of settlement is announced as the judgment of this court in this suit, or so soon thereafter.
“The planned fresh primaries for the Akoko South-East/Akoko South-West Federal Constituency will be observed by the competent officers of the second defendant,” the second defendant stated.
“That this honorable court’s ruling in this case shall be in the aforementioned terms. Parties are responsible for their own charges.
