Babatunji Wusu –

A lawsuit to remove the seats of 25 lawmakers who were accused of defecting from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) was dismissed by a Rivers State High Court in Port Harcourt.

The court’s decision on Thursday upheld the MPs’ positions, stating that there was insufficient proof of their alleged defection.

Judge Okogbule Gbasam presided over the verdict, which found that the parliamentarians continued to be PDP members despite the claimants’ inability to provide evidence to support their assertions that they had formally joined the APC. The decision essentially overturns a previous interim injunction that the same court had issued.

Remember that the court had originally ruled the MPs’ seats vacant on May 30 until the ongoing legal case was resolved.

The 24 other parliamentarians, who were also against Governor Seminalayi Fubara, were likewise prohibited from carrying out legislative duties by this preliminary ruling, as was Rt. Hon. Martin Amaewhule from serving in that capacity.

Allegations that the 25 MPs had defected to the APC, a move seen as unfriendly to the state’s government under the PDP leadership, sparked the dispute.
