According to Nnamdi Kanu’s special counsel, Aloy Ejimakor, the Supreme Court is already hearing the matter, hence Justice Binta Nyako of the Federal High Court cannot move forward with the separatist leader’s trial.
In response to Kanu’s absence from Monday’s court appearance before Nyako in Abuja, Ejimakor issued this declaration.
The IPOB leader allegedly declined to show up in court despite being informed, according to a previous report from the Federal Government’s attorney. However, Chief Mike Ozekhome, SAN, the IPOB leader’s primary attorney, countered that they learned about the case from social media.
“My Lord, I realize the defendant chose not to appear in court today. The defendant was informed of this sitting as of last week, and he had no objections.
“However, I was informed when I called the office this morning that the defendant woke up and decided not to appear in court. The government’s attorney informed the court that despite numerous requests and pleadings, the defendant refused to appear.
Kanu’s defense team is being led by Ozekhome, who reportedly found the FG’s accusation odd.
“My lord, this is completely surprising to me because this guy has never concealed his desire to be in court all the time. In reality, the defendant stated that he would wish to attend court for the hearing of all the items in both processes we filed with the Court of Appeals and the Supreme Court.
In a response statement he provided to Vanguard, Ejimakor said that the two earlier judgments from the Federal High Court and Appellate Court in Umuahia, Abia state, were obstacles to today’s decision.
Kanu’s attorney claimed that what transpired in Abuja today was predictable because the two rulings had forced his client’s case to be heard by the nation’s highest court.
“(This is) my response to today’s Federal High Court of Abuja decision to halt Nnamdi Kanu’s ongoing trial. It was thought that Justice Binta of the Federal High Court in Abuja will rule today.
“Given the jurisdictional hurdles erected by the Court of Appeal’s and the Federal High Court’s judgments, there is absolutely no way she can move forward with the trial of Nnamdi Kanu.
“To top it all off, an appeal in the case is currently ongoing before the Supreme Court. According to Ejimakor, “No trial court may proceed with any trial that is burdened by these three considerations.
