On Tuesday, the Court of Appeal in Abuja reinstated Umo Eno as the Peoples Democratic Party’s (PDP) candidate for governor of Akwa Ibom State.
Since the Federal High Court in Abuja named Michael Enyong, a member of the House of Representatives, as the PDP’s flagbearer for the state’s 11 March governorship election, Mr. Eno had been fighting to reclaim the party’s governorship.
The Federal High Court’s judgment from January 20th, which dismissed Mr. Eno, was overturned by a three-member bench of the Court of Appeal, led by Hamman Barka.
Mr. Barka claimed that the trial court’s judgment was flawed.
The Federal High Court judge Fadima Aminu was mislead by Mr. Enyong in coming to an unfair judgment, the appellate court agreed with Mr. Eno’s attorneys Paul Usoro and Uwemedimo Nwoko.
The problem of statutory delegates who participated in the primary election, according to Mr. Barka, is a PDP internal matter.
He continued by saying Ms. Aminu should not have inquired about the matter of the party’s statutory delegates.
The Federal High Court’s decision in favor of Mr. Enyong was therefore reversed, and the appeal court upheld Mr. Eno’s claim.
In the meantime, the court punished Mr. Enyong N1 million in Mr. Eno’s favor.
Before the election on March 11th, the APC in Akwa Ibom State still lacked a governorship candidate.
