Joshua Gana’s certificate of return as the representative of the Edati/Lavun/Mokwa Federal Constituency in the Niger State has been removed by the National and State Houses of Assembly Election Tribunal, which is located in Minna.
Mr. Gana is the son of Jere Gana, a former minister and director of the DFFRI, which stands for Directorate for Food, Roads, and Infrastructure.
In its ruling, the tribunal mandated that a second election be held in the constituency’s 26 polling places.
The dismissal of Mr. Gana followed a plea that the All Progressive Congress (APC) candidate, Abdullahi Usman-Gbatamagi, submitted to the tribunal through his attorney, Johnson Usman (SAN).
In contrast to Mr. Usman-Gbatamagi, Mr. Gana, a member of the Peoples Democratic Party (PDP), received votes.
Mr. Usman-Gbatamagi stated that Mr. Gana shouldn’t have been recognized as the election’s victor because he fell short of the threshold set forth in the Electoral Act of 2022.
In his defense, he claimed that his margin of victory was smaller than the number of registered voters (14,411) who were present in the polling places where the polls were postponed or canceled.
The tribunal supported him. The tribunal also ruled that 26 voting units’ votes were illegitimate, bringing Gana’s vote total down to 46,494 and Gbatamagi’s vote total down to 39,159.
The tribunal’s decision is still subject to appeal by Mr. Gana.
