The Peoples Democratic Party (PDP) state chapter requested permission from the federal high court in Osogbo, Osun state’s capital, to amend its earlier lawsuit against the state’s local government election on October 15. The court granted the request on Thursday.
However, the party’s additional request for the court to halt local government elections is still pending in court.
In his decision, Justice Nathaniel Ayo-Emmanuel approved the PDP application and permitted the modification of the lawsuit, stating that a revision to the original summons would not alter the nature of the ongoing litigation.
Hashim Abioye, the PDP’s attorney, pleaded with the court earlier in the hearing to grant PDP’s relief requests, claiming that the modification would not alter the case’s appearance.

Abioye emphasized that the case was not related to the upcoming elections and urged the court to accept PDP’s relief requests.
The party’s attorney insisted that while the original summons to halt the LG election was still pending, the current appeal sought to highlight the OSSIEC LAW 2022, passed by the Osun State House of Assembly.
Abioye further asserted that his client’s amendment request primarily concerned the interpretation of a few sections of the Electoral Act of 2022 and the application of the Supreme Court’s ruling in the case of OSSIEC v. Action Congress to the conduct of local government elections in the state.
However, Mr. Saka Layonu of the Independent State Electoral Commission (OSSIEC) opposed the proposal, claiming that it was overreaching and able to alter the course of the ongoing lawsuit.
However, Justice Ayo-decision Emmanuel’s approved the PDP application and permitted the suit’s amendment.
However, the PDP lawsuit seeking to halt the local government election hearing was postponed till September 26th.
