A group supporting former minister of state for education Chukwuemeka Nwajiuba filed a lawsuit at Abuja’s Court of Appeal, seeking to overturn Asiwaju Bola Tinubu’s selection as the APC’s presidential candidate (APC).
In a ruling issued on February 17 by a three-person court panel, it was determined that the appeal filed by the Incorporated Trustees of Rights for Everyone International (ITRAI) was inadmissible.
It maintained the APC’s contention that the case the appellant brought before the Federal High Court of Abuja, the trial court, was not a pre-election matter since the appellant was an NGO and so was not a person covered by Section 285(14)a, b, or c of the 1999 Constitution.
The ruling of the lower court was not appealed, the appellate court said, because the Nwajiuba, who was a party in the case at the lower court, had been removed.
The court then decided to dismiss the appellant’s price of appeal. The court dismissed the entire appeal for being meritless on the merits.
The appeal was an effort by the appellant, the Incorporated trustees of Rights for All International, to resurrect itself after being previously disbanded by the trial court’s ruling, the court remarked.
