On Wednesday, the Supreme Court postponed its decision on Ahmed Lawal’s petition challenging the lower courts’ recognition of Bashir Machina as the legitimate All Progressives Congress (APC) candidate for the Yobe North Senatorial District until February 6, 2023.
After the parties adopted their briefs of arguments in the case, a five-judge panel of the supreme court, chaired by Justice Centus Nweze, set the date.
Recall that the Court of Appeal’s Abuja division upheld the Federal High Court’s decision in Damaturu, Yobe, identifying Bashir Machina as the APC’s legitimate candidate for the Yobe North Senatorial District.
The Court of Appeal’s President, Justice Monica Dongban-Mensem, presided over a three-judge panel of justices that unanimously dismissed the appeal filed by Senate President Ahmed Lawal for lack of merit and addressed all of the grounds he raised against him.
According to Justice Fadima Aminu of the Federal High Court, Bashir Sheriff Machina is still the APC’s legitimate candidate for the Yobe North Senatorial District.
She said that because INEC failed to oversee the poll, the “phantom June 9 primary election” that resulted in Ahmed Lawan, the Senate President, as the victor and candidate, was a “nullity.”
