In the controversy over who should run for governor of Delta State on the Peoples Democratic Party platform, the Supreme Court has set a decision date of October 21. (PDP).
After hearing from attorneys for the parties in David Edevbie’s appeal of the Court of Appeal, Abuja’s August 29 ruling, a five-member panel chaired by Justice Amina Augie announced the date.
In its ruling, the Court of Appeal overturned the Federal High Court’s ruling on July 7 that had revoked Sheriff Oborevwori’s candidacy as the Speaker of the Delta State House of Assembly.
Oborevwori won the party’s governorship primary on May 25, but Edevbie contested Oborevwori’s candidacy, arguing that Oborevwori had presented forged paperwork to the PDP and so shouldn’t have been permitted to compete.
Justice Taiwo Taiwo of the Federal High Court in Abuja ruled on July 7, 2022, upholding Edevbie’s claims and invalidating Oborevwori’s nomination. On August 29, 2022, the Court of Appeal in Abuja overturned that ruling.
Tayo Oyetibo (SAN), representing the appellant (Edevbie), argued the appeal’s case and requested the court to grant it.
Contrary to what Oborevwori and the PDP claimed, Oyetibo contended that the case was properly started in the trial court via an originating summons in accordance with the Chief Judge’s practice directive.
