The Federal High Court in Abuja has dismissed a complaint filed by former Minister of State for Education, Chukwuemeka Nwajiuba, seeking to overturn Asiwaju Bola Tinubu’s nomination as the All Progressives Congress presidential candidate (APC).
Justice Zainab Abubakar ruled on Friday that she lacked authority to hear the case.
It was statute-barred, she said, because it was submitted beyond the 14-day period provided by Section 285(9) of the Constitution.
Tinubu, the APC, and the Independent National Electoral Commission (INEC) were named as defendants in the FHC/ABJ/CS/1114/2022 action.
This is the second time the Federal High Court has dismissed Nwajiuba’s challenge against Tinubu’s nomination.
On December 15, Justice Inyang Ekwo (also of the Federal High Court in Abuja) dismissed the suit filed by Nwajiuba and a group called Rights for All International (RAI).
They sought to overturn Tinubu and Atiku Abubakar’s nominations as presidential candidates for the APC and the Peoples Democratic Party, respectively (PDP).
Nwajiuba had asked the court, among other things, to name him as Tinubu’s replacement as APC candidate.
Justice Ekwo issued an order abolishing RAI, noting that its involvement in politically motivated cases breached its stated purposes and harmed public policy.
